Last updated: 13 October 2026 Quick answer: A loan against property (LAP) is a secured loan against a house, flat or commercial premises you own. Lenders usually lend 50–70% of its market value, at rates higher than home loans: ICICI Bank's card started at 10.60–11.60% before the October 2026 repo hike. Floating-rate LAPs to individuals carry no prepayment charges, but default can cost you the property. Key takeaways LTV: typically 50–70% of market value, set by lender policy, lower for commercial property. Rates: repo-linked LAPs reset upward after the RBI raised the repo rate to 5.50% on 7 October 2026. Cost: ₹50 lakh at 11% for 15 years means an EMI of ₹56,830 and ₹52.3 lakh of interest. Prepayment: RBI's 2025 Directions bar charges on floating-rate loans to individuals for non-business use, for loans from 1 January 2026. Risk: after 90 days overdue, lenders can enforce under SARFAESI without going to court. A Pune business owner needs ₹50 lakh to fund a new unit. Unsecured loans of that size are hard to get and expensive. His flat in Baner, worth around ₹1.5 crore, is sitting idle as collateral. A loan against property looks like the obvious answer, and often it is a good one. But it is also the only common loan where the price of getting it wrong is your home. This guide explains what a loan against property is, how much you can borrow, what it costs after the October 2026 rate hike, the RBI rules on prepayment and transparency that protect you, and the risks to weigh before you sign. All figures are as of October 2026. What is a loan against property? A loan against property is a secured loan in which you mortgage a property you already own, residential, commercial or sometimes industrial, to borrow money for almost any lawful purpose. Unlike a home loan, the money is not tied to buying or building a house. Banks, housing finance companies and NBFCs all offer it. Common uses include business working capital or expansion, a child's education, medical costs, a wedding and consolidating expensive debt. Most lenders' end-use terms exclude speculative purposes, such as trading in shares or buying land for resale. Some lenders also offer LAP as an overdraft: you get a limit and pay interest only on what you use. There are two related products. Lease rental discounting lets owners of rented commercial property borrow against future rent. A LAP balance transfer moves an existing loan to a cheaper lender, often with a top-up. How much loan against property can you get? LTV and eligibility For home loans, the RBI sets loan-to-value (LTV) caps of 90%, 80% and 75% depending on loan size. For a loan against property there is no equivalent single cap; each lender's credit policy decides. In practice, comparison data from aggregators such as Paisabazaar (https://www.paisabazaar.com/loan-against-property/interest-rates/) show lenders usually going up to about 70% of market value, sometimes 75% for strong residential collateral. Commercial and industrial property, and older or self-constructed buildings, usually get less. The property value is only one limit. The lender also checks repayment capacity: the share of your monthly income already going to EMIs, called FOIR. Many lenders cap total EMIs at roughly 50–65% of income depending on income level. Your loan is the lower of the two limits. Check What lenders look at Example: ₹1.5 crore flat Property value Lender's own valuation, not your asking price Valued at ₹1.4 crore LTV limit Often 50–70% by property type 60% gives ₹84 lakh Income limit (FOIR) Net income, existing EMIs ₹2.5 lakh a month, no EMIs: about ₹1.25 lakh for EMIs Credit score Bureau score and repayment record Higher score, lower spread Title and approvals Clear title, approved plan, OC, society NOC Missing papers can stop the loan All owners of the property normally have to join as co-borrowers or guarantors. If the flat is jointly owned with a spouse or parent, they sign too, and they share the liability. Loan against property interest rates after the October 2026 hike The RBI raised the repo rate by 0.25% to 5.50% on 7 October 2026, its first hike since February 2023. Our explainer on the October 2026 repo rate hike (/insights/rbi-repo-rate-hike-october-2026-emi-fd-debt-funds) covers the wider impact. Most bank LAPs are linked to an external benchmark, usually the repo rate, so they move with it at the next reset. Public sector banks raised their repo-linked lending rates by 0.25% within a day. Punjab National Bank, for example, moved to 8.35%, as our home loan guide (/insights/home-loan-guide-2026) details. Your LAP rate is that benchmark plus a spread, and the spread on LAP is wider than on a home loan. ICICI Bank's published card for non-housing loans, including LAP, shows how pricing works. The card, valid until 30 September 2026 and linked to a repo rate of 5.25%, starts at 10.60% for loans above ₹1 crore and 11.10% for loans up to ₹50 lakh for priority-sector customers. Self-employed non-priority customers pay about 0.50% more. Expect roughly 0.25% more on repo-linked pricing after the hike. Final rates depend on credit score, profile and segment. Public sector banks often quote lower starting rates, while NBFCs and smaller housing finance companies tend to charge more but may accept weaker paperwork or non-standard property. Always compare quotes on the same basis: the benchmark, the spread, all fees and the annual percentage rate (APR). Fees beyond the interest rate Expect a processing fee (commonly a percentage of the loan, plus 18% GST), legal and valuation charges, stamp duty on the mortgage deed where applicable and, for some lenders, a charge for a credit report. Since October 2024, lenders must give you a Key Facts Statement with the APR and all charges before you sign, under the RBI's Key Facts Statement circular (https://www.rbi.org.in/Scripts/NotificationUser.aspx?Id=12663&Mode=0) . Fees not listed there cannot be charged later without your consent. What does a ₹50 lakh LAP really cost? A worked example Back to the Pune business owner. He borrows ₹50 lakh against his flat at 11% a year, floating. Here is what tenure does to his cost: Tenure EMI Total interest Total repaid 5 years ₹1,08,712 ₹15.2 lakh ₹65.2 lakh 10 years ₹68,875 ₹32.7 lakh ₹82.7 lakh 15 years ₹56,830 ₹52.3 lakh ₹102.3 lakh Loan against property EMI example: total interest on ₹50 lakh at 11% is ₹15.2 lakh over 5 years and ₹52.3 lakh over 15 years Stretching from 10 to 15 years cuts the EMI by about ₹12,000 a month but adds almost ₹20 lakh of interest. The rate hike adds to this. If his 11% rate rises to 11.25% after the October 2026 hike, the 15-year EMI goes up by ₹787 to ₹57,617, or the lender extends the tenure by about seven months if the EMI is held constant. Our article on raising the EMI vs extending the tenure (/insights/home-loan-emi-vs-tenure-after-rate-hike) explains how to choose, and our EMI calculator guide (/insights/emi-calculator-guide-reduce-loan-interest) shows how prepayments cut total interest. You can run your own numbers on our EMI calculator (/tools) . Can you prepay a loan against property without penalty? Usually yes, if it is floating-rate. The RBI (Pre-payment Charges on Loans) Directions, 2025 (https://www.rbi.org.in/Scripts/NotificationUser.aspx?Id=12878) , issued on 2 July 2025, apply to loans sanctioned or renewed on or after 1 January 2026: Individuals, non-business purpose: no prepayment or foreclosure charge on floating-rate loans, from any regulated lender, including co-borrower loans. Individuals and micro and small enterprises, business purpose: no charge on floating-rate loans from commercial banks (other than small finance, regional rural and local area banks), Tier 4 urban co-operative banks, upper-layer NBFCs and all-India financial institutions. Smaller lenders, business purpose: small finance banks, regional rural banks, Tier 3 urban co-operative banks, state and central co-operative banks and middle-layer NBFCs cannot charge on such loans up to ₹50 lakh. No lock-in, any source: the rules apply whatever the source of the money and with no minimum lock-in period. Fixed-rate loans: charges follow the lender's policy and must be disclosed in the sanction letter, agreement and Key Facts Statement. Why this matters for LAP: many LAPs are taken for business use, and many come from NBFCs. A self-employed borrower taking a ₹1.2 crore business LAP from a middle-layer NBFC can still face a foreclosure charge, so check the Key Facts Statement. Loans sanctioned before 1 January 2026 follow the older rules and your loan agreement. Getting your documents back Once you repay in full, the lender must return all original property documents and remove the registered charge within 30 days, under an RBI directive of 13 September 2023 (https://rbi.org.in/Scripts/NotificationUser.aspx?Id=12535&Mode=0) . For delays caused by the lender, it must pay you ₹5,000 for each day of delay. If documents are lost, it must help you get certified copies at its cost. Loan against property vs home loan vs personal loan Comparison of loan against property vs home loan vs personal loan by use, LTV, rate and risk A LAP sits between a home loan and a personal loan. It is cheaper than most unsecured credit and allows large amounts and long tenures, but it puts a valuable asset at risk. For smaller, short-term needs, a loan against mutual funds or a gold loan can be cheaper and quicker; our comparison of personal loans, loans against mutual funds and gold loans (/insights/personal-loan-vs-lamf-vs-gold-loan) covers those options. Tax treatment of LAP interest There is no special deduction for a LAP. The tax treatment depends on how you use the money. If it funds your business, the interest is generally a business expense. If it is used to buy or build another house, the interest may qualify under the house property rules, now in section 22 of the Income-tax Act, 2025, as our guide to home loan tax benefits (/insights/home-loan-tax-benefits-old-new-regime) explains. For a wedding or a holiday, there is no deduction. Keep records showing where the money went. What are the risks of a loan against property? Losing the property: this is the big one. The loan is secured by your home or office, and the lender can enforce without a court decree. Long-tenure cost: 15-year tenures make large loans feel affordable while the interest exceeds the principal. Rate risk: floating rates move with the repo rate, and the RBI's stance is now "calibrated tightening". A further hike at the December 2026 policy would raise costs again. Business risk spills into family risk: if a business loan is secured on the family home, a business failure becomes a housing crisis. Co-owner liability: a spouse or parent who co-signs is equally liable. Lower flexibility: a mortgaged property cannot be sold or gifted without clearing the loan or the lender's consent. What happens if you default on a LAP? Once your loan is overdue for more than 90 days, it is classified as a non-performing asset. Lenders covered by the SARFAESI Act, 2002 can then issue a 60-day demand notice under section 13(2), as explained in this SARFAESI overview (https://www.bajajfinserv.in/sarfaesi-act-2002) . If you do not pay or reply satisfactorily, they can take possession under section 13(4) and auction the property. You can raise objections to the notice and appeal to the Debt Recovery Tribunal under section 17. Steps showing what happens on loan against property default under the SARFAESI Act, from missed EMIs to auction If trouble is coming, talk to the lender early. Restructuring, a tenure extension or selling the property yourself usually recovers far more value than a distress auction. Our guide to managing debt (/insights/debt-management-guide-india) covers the options. Before you sign: a seven-point checklist Confirm the need. Is the purpose productive enough to justify putting the property at risk? Borrow the minimum. Being eligible for ₹84 lakh does not mean you should take it. Pick the shortest affordable tenure. Keep total EMIs comfortably within your income, with room for a rate rise. Compare three lenders on benchmark, spread, APR and all fees in the Key Facts Statement. (/insights/prepay-home-loan-or-invest) Frequently Asked Questions What is the current loan against property interest rate? Rates vary by lender, loan size and profile. ICICI Bank's card, valid to 30 September 2026 before the hike, started at 10.60% for loans above ₹1 crore and 11.10% for loans up to ₹50 lakh, with self-employed non-priority borrowers paying about 0.50% more. After the October 2026 repo hike, repo-linked rates are typically about 0.25% higher. Ask for a current quote. How much loan can I get against my property? Most lenders lend about 50–70% of the property's market value as assessed by their own valuer, sometimes up to 75% for good residential property, and less for commercial or industrial property. The final amount is also limited by your income and existing EMIs, so the eligible loan is the lower of the property-based and income-based limits. Is there a prepayment penalty on a loan against property? Not on floating-rate loans to individuals for non-business purposes sanctioned from 1 January 2026, under RBI's 2025 Directions. For business-purpose LAPs, most banks and large NBFCs cannot charge either, but some smaller lenders can on loans above ₹50 lakh. Fixed-rate loans follow the lender's policy. Check the Key Facts Statement before signing. Can I take a loan against a property that already has a home loan? Sometimes. If your home loan is partly repaid and the property has risen in value, the same lender may offer a top-up or a LAP on the unencumbered value. Another lender would usually need to take over the existing loan through a balance transfer. Taking a second charge is uncommon and lenders treat it cautiously. What happens to my house if I cannot repay a LAP? After 90 days overdue, the loan becomes an NPA. Lenders covered by the SARFAESI Act can send a 60-day demand notice, then take possession and auction the property without a court order, though you can object and appeal to the Debt Recovery Tribunal. Speak to the lender early; restructuring or a voluntary sale preserves more value. Is a loan against property better than a personal loan? For large amounts and long tenures, LAP usually costs less than a personal loan because it is secured. But it takes longer to process, involves legal and valuation fees, and risks your property. For small or short-term needs, a personal loan, a loan against mutual funds or a gold loan can be simpler and less risky overall. Is LAP interest tax-deductible? It depends on how you use the money. Interest on funds used in your business is generally a deductible business expense. If the money buys or builds another residential property, the interest may qualify under the house property rules (section 22 of the Income-tax Act, 2025). Interest on loans for personal spending is not deductible.
